1. Scope
These CGV (general terms and conditions of sale) apply to all surveys and/or services carried out by CBDI within the limits of the skills and insurance it holds. The general terms of intervention (CGI) form an inseparable whole with these CGV.
By placing an order with CBDI, the customer (or "client") shall be deemed to have accepted these CGV and the CGI, and to have read them beforehand, either through the assignment order or by consulting the website www.cbdi.fr.
2. Ordering
An order, whether placed in writing or orally, constitutes simultaneous acceptance of these CGV and of the CGI by the client. The client undertakes to provide CBDI with the name and contact details of the notary (notaire) handling the sale.
The client is asked to provide CBDI, as early as possible, with all the documents in their possession (in particular any previous surveys received when the property was bought).
The client's use of the report (and/or preliminary report) issued by CBDI shall be proof of the order itself and of the sum owed to CBDI for the price of its service.
The order gives CBDI authority to call on an external provider (e.g. an analysis laboratory) for the scientific analysis of items collected on site.
3. Purpose and limits of the service
The service provided by CBDI consists exclusively of the survey ordered, as defined by the legal, regulatory or normative provisions in force, or of any other physical examination falling within its area of competence (e.g. loi Carrez measurement (floor area certification)).
As it is based on a visual, non-destructive inspection, this service excludes any technical appraisal and/or project management, even if CBDI happens to make recommendations or provide cost estimates. It therefore does not replace consulting a specialist professional before the client makes any decision.
The service reflects the apparent condition of the property on the day of the survey and has no predictive value as to its future condition. Any significant change to the property after our service renders the report issued void, regardless of its age.
Our service is only a snapshot of the property at a given moment. Any later reuse of the report by a third party, or for purposes unrelated to the service ordered, is at the sole risk of the person reusing it. We recommend asking CBDI about the precautions to take before any reuse.
4. Carrying out the service on site
The client or their representative is present on site to give access to all the premises, or provides a set of keys in advance together with all useful information. They inform CBDI of any inaccessible premises or of equipment requiring the assistance of qualified staff.
The surveyor may be accompanied by an examiner representing the certification body for an on-site check. An examiner may also contact the client after the visit, with the client's consent, to check the DPE or the energy audit.
5. Costs relating to external services
CBDI may need to call on external providers (e.g. an analysis laboratory). The related costs will be included in the total cost invoiced to the client, who undertakes to pay them.
6. Preliminary asbestos report
In the case of an asbestos survey, CBDI will issue a "preliminary report" where its assignment could not be completed for reasons beyond its control (e.g. lack of safe access). This preliminary report is a service in its own right and is invoiced; the customer may not rely on the absence of a final report to dispute it.
The final report issued after an additional inspection may not be used independently of the preliminary report, as the two documents form an inseparable whole, and constitutes a new service.
7. Additional investigations
Where CBDI recommends additional investigations (e.g. destructive probing) to resolve a doubt, these may be carried out later as part of a new assignment, whose price and terms will be agreed in writing beforehand.
The new report may not be used without also producing the initial report, and vice versa.
8. Client's obligations
In accordance with Article 1104 of the French Civil Code (Code civil), the client must act in good faith and cooperate honestly with CBDI throughout the contractual relationship. They must volunteer any information they are aware of that may help with the survey.
If they notice obvious errors in the report received, they undertake to inform CBDI immediately and not to use the report until a corrected report has been issued, where applicable.
If useful information is concealed or withheld, CBDI reserves the right to seek compensation from the client should a claim be brought against it.
9. Prices and payment terms
For a standard assignment, the price is the one shown in the price list displayed at CBDI's registered office and/or published on www.cbdi.fr. For any other service, the price is set according to the information provided by the client (if information is incorrect or incomplete, the price may be revised upwards).
Our services are payable on receipt of the invoice. A complaint about the content of the service never exempts the client from paying for it. In the event of non-payment despite formal notice, CBDI will enforce recovery of the sum owed through the notary handling the sale.
Prices: set according to the year the property was built, its floor area and the number of surveys required. A detailed, tailored quote is always drawn up before any visit.
- Call-out fee: €50 including VAT per visit.
- Additional costs — Asbestos sampling: €60 including VAT per sample.
Any renewal or update of a survey is invoiced separately. No renewal is carried out free of charge.
10. General Data Protection Regulation (GDPR)
In accordance with European Regulation (EU) No 2016/679 of 27 April 2016, the information provided to CBDI by the client may be used to send them commercial offers, unless they object at any time in the way that suits them (in particular via www.cbdi.fr). The client has the right to access, rectify and delete this information by registered letter sent to CBDI's registered office or by email to contact@cbdi.fr.
For more information on the GDPR: cnil.fr. See also our privacy policy.
11. Out-of-court settlement of disputes / free mediation
In accordance with Articles L 611-1 and R 612-1 et seq. of the French Consumer Code (Code de la consommation), a consumer who has not obtained satisfaction after a written complaint may submit their complaint to the consumer mediator free of charge, within a maximum of one year.
The mediator MCP MEDIATION can be contacted online (www.mcpmediation.org) or by post: Médiation de la Consommation et Patrimoine, 12 Square Desnouettes, 75015 Paris, France. The request must be accompanied by all relevant supporting documents (surveys, quotes, correspondence) and set out the facts clearly.
12. Opting out of telephone canvassing
You can register free of charge on the telephone canvassing opt-out list at www.bloctel.gouv.fr.
