Loi Boutin living area survey in Bordeaux

The exact living area to state in your tenancy agreement, furnished or unfurnished.

Letting a flat in Bordeaux, a house in Pessac or a furnished home in Lacanau on a long-term basis? The tenancy agreement for a main residence must state the living area of the property. That is the loi Boutin (living area certificate).

CBDI issues your living area certificate after measuring the whole property on site. Our office is in Mérignac and our surveyors are Qualixpert-certified: we visit within 24 to 48 hours across Gironde and send the report within 48 hours.

When must the living area be stated?

The living area must appear in the tenancy agreement for any property let furnished or unfurnished as the tenant's main residence. Whether or not it is in shared ownership makes no difference: flats, houses and studios are all covered.

Landlords can measure the property themselves, but they are liable for the figure. Using a certified surveyor gives you solid ground if your tenant disputes it.

What we measure and what we exclude

Living area is the built floor area after deducting walls, partitions, steps and stairwells, ducts, and door and window recesses. It is stricter than the Carrez area.

The following are not counted: unconverted lofts, cellars, basements, garages, terraces, loggias, balconies, conservatories, storerooms and any area with a ceiling height below 1.80 m. The report details every room.

Validity and the cost of an error

A living area certificate has no expiry date. You can reuse it for every new tenancy as long as no works change the floor area.

If the actual area is more than 5% smaller than the figure in the tenancy agreement, the tenant can ask for a rent reduction in proportion to the shortfall. An accurate measurement from the outset avoids that kind of claim.

Rental properties in Bordeaux and Gironde

In Bordeaux, many rented homes are in échoppes or stone buildings split into flats, in Chartrons, Caudéran or La Bastide. Sloping ceilings, mezzanines and attic rooms often reduce the living area.

Around the Pessac and Talence campuses, studios and furnished flat-shares are let as main residences. In Mérignac and Bègles, rented houses often have a garage or conservatory, both excluded. In the Médoc, a house let all year round must also state its living area in the lease.

Frequently asked questions : loi boutin living area

Does the loi Boutin apply to furnished lettings?

Yes, as long as the property is let as the tenant's main residence. Furnished or unfurnished, the living area must appear in the lease. A holiday let, such as a second home rented by the week in Lacanau, falls outside this scope. A Médoc house let all year round as a tenant's main residence, however, is covered by the rule.

What is the difference between Carrez area and living area?

The Carrez area applies to the sale of a unit in shared ownership. The living area applies to lettings. Both exclude areas below 1.80 m, but living area also leaves out spaces the loi Carrez can include, such as conservatories or unconverted lofts. For the same property, the two figures often differ.

How long is the certificate valid?

It does not expire. You can reuse it for each new tenant as long as the property has not been altered. If you remove a partition, convert the loft or create a new room, have it measured again. Keep the report with your letting documents so you can attach it to every new lease.

Who pays for the loi Boutin survey?

The landlord. The landlord must state the living area in the lease and faces a rent reduction if the error exceeds 5%. We send you a free quote within 24 hours. The measurement can be done at the same time as your other rental surveys.

How long does the visit take?

Time on site depends on the floor area and number of rooms. A studio is quick; a house on two floors with outbuildings takes longer. If the property is occupied, let your tenant know and make sure every room, cupboards included, is accessible. The report is sent to you within 48 hours.
