ERP (risk and pollution statement) in Bordeaux

The compulsory information on the risks at your address, for selling or letting in Gironde.

Flooding, clay soils, forest fires, aircraft noise: in Bordeaux and Gironde, the listed risks are varied. The ERP (risk and pollution statement) tells the buyer or tenant exactly which risks apply to the property.

CBDI prepares your ERP from the official documents in force for your town and your plot. Based in Mérignac and Qualixpert-certified, we deliver the report within 48 hours, on its own or with your other surveys.

When is an ERP compulsory?

The ERP is compulsory for every sale and every letting of a property in an affected area: natural, mining or technological risk prevention plans, seismic zones, radon potential, polluted soil information areas, and areas exposed to coastal retreat.

If the property lies within an airport noise exposure plan, that must be disclosed too. Since 1 January 2023, buyers and tenants must be informed of the risks from the early stages of the sale or letting, not just at signature.

What your risk statement contains

We identify the prefectoral orders and prevention plans that apply to the exact address of the property. The document states whether the plot is exposed, to which risk, and whether works are required by a prevention plan.

The seller or landlord also completes the declaration of claims paid out for natural or technological disasters during their ownership. We help you fill in this section correctly.

How long it is valid

The ERP must be less than 6 months old when the preliminary contract, the deed or the lease is signed. Prevention plans and zoning change: an old document may no longer reflect the property's real situation.

If the final deed is signed more than 6 months after the ERP was issued, it must be updated. We redo it quickly, using the data in force on the new date.

Known risks in Bordeaux and Gironde

Depending on the address, the ERP may flag flooding from the Garonne and its streams (jalles), marine flooding around the Arcachon Bay and the estuary, or clay shrink-swell, which affects parts of the Bordeaux metropolitan area such as Mérignac, Pessac, Talence or Bègles.

On the Médoc coast, in Lacanau or Soulac, some towns are affected by coastal retreat. The wooded areas of the Médoc are exposed to forest fires. Around Bordeaux-Mérignac airport, the noise exposure plan may also cover your property.

Frequently asked questions : risk and pollution statement (erp)

Is an ERP compulsory for a letting?

Yes, whenever the property lies in an area affected by a listed risk. It is attached to the lease, furnished or unfurnished. The tenant must be informed from the early stages of the letting, before signing. Give us the address and we will check whether it is affected before you publish your listing.

Can I fill in the ERP myself?

Yes, the law does not reserve the ERP to surveyors, and public tools let you prepare it. Common mistakes are plentiful though: wrong plot, misread prevention plan, forgotten claims declaration. An inaccurate ERP can weaken the sale or the lease. We prepare it for you and add it to the rest of your file.

How long is an ERP valid?

It must be less than 6 months old when the preliminary contract, final deed or lease is signed. If your sale is delayed, it must be updated before the deed. We redo it quickly using the orders and zoning in force on the new date, without another visit.

Who pays for the risk and pollution statement?

The seller for a sale, the landlord for a letting. It is their duty to inform the buyer or tenant. We offer a free quote within 24 hours. The ERP can be ordered on its own or with the other surveys in your file, which makes things simpler with the notaire or the agency.

Does the ERP require a visit to the property?

No. The ERP is based on official documents linked to the address and the plot. We need the exact address or the land registry references, and your information on any insurance claims paid out. If we are visiting for other surveys, we use the opportunity to check these details with you on site.
